Class Action Trends From 2015

More than half of major companies are currently engaged in class litigation, and about 10 percent of overall litigation spending for those companies is dedicated to defending class actions, according to Gibson Dunn. In a detailed overview, Gibson Dunn reviews the significant decisions the Supreme Court released in regards to interpreting and applying the new, more stringent rules governing class actions. Attention from the Court “represents an important shift,” the report states, noting that from the advent of the modern class action in 1966 to 2000 there were eight key Supreme Court decisions regarding Rule 23, and in the past five years there have been thirteen, with more on the way in 2016.
