Chinese Court Decisions Must Be Published Under New Regs

Under a regulation that went into effect Jan. 1, The Supreme People’s Court of China has mandated that all courts in that country must publish decisions on a central website, within a week of the ruling. Previously, the courts were merely encouraged to publish decisions, on their own websites, within 30 days. Though there are some exceptions, and redactments of certain kind of information are allowed, the new regulation “has fundamentally improved public access to Chinese jurisprudence,” write Herbert Smith Freehills attorneys Jessica Fei, Brenda Horrigan and Arthur Ma.
