Cautions When Considering Job Applicant Arrest Records

The EEOC has declared that eliminating barriers to hiring is one of its priorities, and one of those barriers can be an arrest record. Guidance issued last year by the EEOC has clarified circumstances in which an arrest or conviction record will or won’t be considered legitimate grounds for refusing to hire. The Commission has demonstrated it will go to court over the matter.
