Citation Bible Bluebook Wary Of ‘BabyBlue’

The “Bluebook” has served as the “bible of legal citation” for nearly a century, but when open-records activist Carl Malamud publicly announced that his planned online rival guide – which will be available free on the internet – would be called “BabyBlue,” the Bluebook’s Ivy League publishers sent a letter from a white shoe IP litigation firm. “It is our client’s position that the title ‘BabyBlue,’ or any title consisting of or comprising the word ‘Blue,’ when used on or in connection with your work, would so resemble the BLUEBOOK Marks as to be likely, to cause confusion, mistake, and/or deception,” IP litigation Peter M. Brody of Ropes & Gray LLP wrote in the letter. Malamud and his project partner, New York University law professor Christopher Sprigman, say they aren’t committed to the “BabyBlue” name, and have no intention of delaying its release.
