Appeals Court Revives Clinton Email Case

One of the legal challenges involving former Secretary of State Hillary Clinton’s use of a private email server has been revived this week, with a federal appeals court saying government agencies should have done more to recover the emails. According to the lawsuit, filed by conservative groups Judicial Watch and Cause of Action, the State Department and National Archives did not do enough to uncover the 55,000 pages of government emails that were run through a private server established at her New York home. In January, a judge said the suit was moot, as the State Department and National Archives made a “sustained effort” to recover and preserve Clinton’s records. But U.S. Court of Appeals for the District of Columbia Circuit judge Stephen Williams said the agencies should have done more. “The Department has not explained why shaking the tree harder – e.g., by following the statutory mandate to seek action by the Attorney General – might not bear more still,” he wrote.
