According to the Erwin McCane & Daly firm, AI is already affecting workers comp insurance on the client side. It enables storage of information about employers and helps calculate settlement values, and risk identification and intervention opportunities. Plaintiffs’ lawyers have begun reporting that they are prevailing in cases based on AI’s ability to find applicable case law or cases almost identical to theirs. Chatbots can enable transcription of conversations from clients who aren’t comfortable typing written versions of their experience, enabling better detail and more information. AI is also useful in analyzing data and making a prediction about the outcome of a case based on relevant data and case files, thus enabling an evidence-based decision about settlement far more accurately than a human.
