Prince Decision Freed Up “Transformative” Use of Copyrighted Images

An attorney who advises clients on fair use explains why she considers the Second Circuit Court of Appeals decision in Cariou v. Prince salutary and long overdue. By allowing an artist to incorporate copyrighted photographs into his paintings, Prince expanded the notion of fair use and limited the circumstances in which a copyright holder can sue for infringement.
