Does The FCPA “Over-Criminalize”?

The Over-Criminalization Task Force of the House Committee on the Judiciary earlier this month heard testimony from advocates who say the Foreign Corrupt Practices Act is a deal-breaker out of control, and  it needs a rewrite. Those testifying included a Morgan, Lewis & Bockius partner who maintains that legitimate overseas business opportunities are lost because the regulatory and enforcement lines are too vague, and companies therefore are unable to properly assess risk.
