Caesar’s Faces Class Action After Data Breach

Caesars Entertainment, which operates eight hotel-casinos on the Las Vegas Strip, is facing a putative class action lawsuit seeking to hold Caesar’s liable for exposing its customers’ personal information to hackers.

MGM, another major presence on the Strip, experienced widespread disruption the last week of November after being hit by cybercriminals.

According to Courthouse News Service, Miguel Rodriguez filed the suit against Caesar’s on Nov. 4 in Nevada federal court in Nevada, on behalf of himself and other members of Caesars’ loyalty programs.

In his filing, the plaintiff noted that Caesar’s had yet to provide notice to affected class members, which deprived them of the chance to take speedy measures to mitigate any harm the breach caused. “Simply put, the defendant impermissibly left plaintiff and class members in the dark — thereby causing their injuries to fester and the damage to spread.”

“Although the data breach was discovered on September 7, 2023, it is presently unknown and/or undisclosed as to when the actual data breach occurred, and for what period of time defendant’s systems were exposed.” Rodriguez wrote.

According to the suit, affected customers are subject to fraud and identity theft. They will have to be extra vigilant and constantly monitor their financial accounts.

Caesars rendered their business “easy prey” for cybercriminals, it says. Nor did it explain the full breadth of the breach in a Sept 14 SEC filing.

The suit seeks many remedies: compensatory damages, treble damages, punitive damages, and reimbursement of out-of-pocket costs. They also seek injunctive relief, including improvements to the defendant’s data security systems, future annual audits, and adequate credit monitoring services funded by the defendant.

“We have taken steps to ensure that the stolen data is deleted by the unauthorized actor, although we cannot guarantee this result,” Caesars Entertainment said in a statement.
