For Hospitals, The Stark Law Snare Still An Issue

Contrary to common belief, the Physician Self-Referral Law, often called the Stark Law, has not been shelved or reserved for the largest violators. In a recent case, overcompensation of specialists, whom the hospital feared would refer patients elsewhere, was judged to be a violation. Intent is not required. Hospitals need to implement active compliance protocols to avoid violations.
