Vermont Has Passed Its Own Patent Reform Law

It’s a first in the nation, says a law firm partner and adjunct law professor who helped in its formulation. He maintains it would survive a preemption challenge. The law allows companies that have been targeted by patent trolls to recover legal costs and damages — but only if the court determines the plaintiff indeed qualifies as a “troll,” meaning the infringement suit meets specific criteria for having been filed in bad faith.
