Ninth Circuit: Nobody Regulates Genetically Modified Alfalfa Seeds

The Ninth Circuit affirmed summary judgment against plaintiff environmental and organic farming groups that wanted an injunction. They claim that the genetically modified product “Roundup Ready Alfalfa,” or RRA, will cross-pollinate with non-modified alfalfa and could sully the entire U.S. crop. The court ruled that RRA is neither pest nor adulterated food of the sort that could be regulated. This, the writer suggests, raises the prospect of a legislative effort and a big lobbying battle.
