CA’s Prop 65 Requirements Have Gotten Tougher

Changes to California’s Proposition 65 product warning requirements took effect on August 30. Prop 65 requires businesses to provide warnings to Californians about potential exposures to chemicals that are on a list of chemicals known to the state of California to cause cancer or reproductive harm. With the new amendments, businesses are required to provide warnings at the time of purchase, which means among other things that internet and catalog sellers must include a warning on their websites and catalogs. The amendments also mandate changes in the text that businesses use to qualify for the law’s “safe harbor” provisions.
