Laterals Bring Most Malpractice Claims

A survey by a major insurance brokerage found the number one reason law firms get sued for malpractice is a conflicts problem involving a lateral hire. “Too often, conflicts are an afterthought when attorneys move from firm to firm; and even when conflicts surface they are often ignored or overlooked,” said Eileen Garczynski, a senior vice president and partner at Ames & Gough, which conducted a survey tapping nine insurers that cover most of the largest U.S. law firms.
