Another Website Alleged In Violation Of ADA

A putative class action alleges the website of an online glasses retailer is not accessible to the visually impaired, in violation of the Americans with Disabilities Act as well as New York City and New York state law. The plaintiff is legally blind – a term that refers to someone with “a visual acuity with correction of less than or equal to 20 x 200,” the complaint says – and he uses a specialized screen-reading program called “Job Access With Speech” (JAWS). The complaint alleges that JAWS will not work properly on the glasses retailer’s website. This post from LawNewsLine notes that, according to defense attorneys, “plaintiff counsel are increasingly targeting retailers for alleged violations of the ADA related to website access for the visually-impaired, especially in the jurisdictions of California, New York and Pennsylvania.”
