Lawsuit Challenges Bipartisan Judgeship Requirements

A lawyer has sued Delaware over the state’s constitutional requirement that judicial nominations and judgeships be evenly split between the two major political parties. Attorney James Adams claims that selecting judges partially on political affiliation, and excluding members of minority parties, is unconstitutional. Adams, who until recently was a registered Democrat, said he wanted to apply for judgeships in the past but discovered he couldn’t because he was not of the required political party.
