Class Action Says PACER Overcharges For Court Docs

A class action alleging that PACER fees are excessive has been certified by U.S. District Court Judge Ellen Huvelle in D.C. federal court. PACER (Public Access to Court Electronic Records) is said to be violating federal law requiring its fees to be no higher than its operation costs. If the plaintiffs prevail, many attorneys who used the service between April 2010 and April 2016 could receive partial refunds. The case is being handled by attorneys from the Gupta Wessler and the Motley Rice law firms, on behalf of three non-profits: the National Veterans Legal Services Program, the National Consumer Law Center and the Alliance for Justice.
