DOL “Persuader Rule” Blocked By Texas Judge

The Department of Labor’s persuader rule, which requires companies to disclose information about law firms or consultants they retain for advice on fending off unions, has temporarily been blocked nation-wide by a preliminary injunction issued by Judge Sam Cummings, U.S. District Court for the Northern District of Texas Lubbock Division. The rule has been widely criticized by business groups and primarily Republican politicians, in part on the contention that it compromises attorney-client privilege. The case is National Federation of Independent Business et al. v. Perez et al. A number of business groups are plaintiffs.
