Justices Consider Stubborn Drunks

The arguments were so awkwardly presented that normally divided U.S. Supreme Court Justices put aside their differences and joked with each other while advocates in Birchfield v. North Dakota stated their case. Nevertheless, Birchfield’s attorneys seemed to have the Constitution on their side when they argued against laws that impose criminal penalties when motorists suspected of drunk driving refuse to take a blood or breath test.
