Judge Applies New Discovery Rules

In March, a judge in the U. S. District Court for the Eastern District of Pennsylvania issued a memo opinion denying a motion for negative inference based on deletion of emails in which he cited the 2016 amendments to the federal discovery rules. The court recognized that a request for an adverse inference is an “extreme remedy,” and applied new Rule 37, which became effective December 1, 2015.
