Text Blaster’s Poor Target Choice: A Plaintiff Lawyer

A California lawyer who specializes in filing Telephone Consumer Protection Act lawsuits over unwanted fax or text solicitations recently got targeted himself, and now he’s the plaintiff in a class action lawsuit. The defendant is EverQuote Inc., doing business as CheaperAutoCoverage.com. “Plaintiff,” says the complaint of Beverly Hills-based attorney Todd M. Friedman, “did not provide Defendant or its agents with prior express consent to receive unsolicited text messages, pursuant to 47 U.S.C. § 227 (b)(1)(A).” The complaint identifies the putative class as anyone in the U.S. who received unsolicited text messages from the defendant without prior consent, and says that class could number in the tens of thousands. The TCPA allows for possible recovery of damages of up to $1500 per violation.
