Appeals Court Questions New Jersey’s Sports Betting

New Jersey’s 2014 law attempting to legalize sports betting by partially repealing a prohibition against it was before a federal appeals court this week. The NCAA and professional sports leagues filed suit against the state after it tried to allow betting at casinos and racetracks. “At some point is a partial repeal is so specific that it is really authorizing,” Third District Court of Appeals Judge Kent Jordan asked New Jersey’s legal representatives during oral arguments. The suit is before 12 judges, who agreed to re-hear the case after a three-judge panel ruled in favor of the sports leagues. “What we have here is a vague, micromanaged tinkering” of the state’s abilities to make its own regulations, said New Jersey attorney Theodore Olson.
