Victoria’s Secret Sued For Sending 97 Texts In One Day

After opting in to a Victoria’s Secret text message marketing program with the understanding he was to receive no more than six message per month, Michael Hannegan was instead inundated with messages, up to 97 in a single day, he claims in a purported class action lawsuit. Hannegan says any messages beyond the six he agreed to receive are unauthorized and in violation of the Telephone Consumer Protection Act. “This case highlights the importance of carefully drafted consent language and the potential for litigation if any information in the disclosures/requests for consent is inaccurate,” Winston & Strawn LLP’s Caroline W. Hudson writes.
