Patent Litigation Capital Sets One Month Record

A flood of patent infringement suits hit the courts in advance of a Dec 1 rules of civil procedure change that will require more details from filers. “Under the new pleading standard, plaintiffs will have to demonstrate that their claims are plausible,” Dallas attorney Jason Wietjes said. More than half of a record 851 patent infringement lawsuits filed in November were filed in the U.S. District Court for the Eastern District of Texas, a litigation blitz that solidifies the reputation of the Eastern District, based in Tyler, Texas, as the patent litigation capital of America.
