SCOTUS Skeptical Of Tyson Class Action Challenge

In a class action case being defended by Tyson Foods, at least two of the justices appeared highly skeptical of the company’s arguments questioning the makeup of the class, according to an article in The Hill. At stake is a $5.8 million judgment against Tyson in a “doffing and donning” case at a pork processing facility in Iowa. Plaintiffs took issue with how Tyson figured added time and pay for employees whose job required them to wield knives and per agreement were supposed to be paid for time spent putting on and taking off required protective gear. “I am completely at a loss as to what you are complaining about,” said Justice Sotomayor to an attorney representing Tyson.
