Superman Fights To Keep “Kryptonite” Off Vapor Smokes

Some comic book history from Gibney, Anthony & Flaherty attorney Michael Lee, as background to a current trademark controversy, with DC comics apparently set to prevail. The mark for kryptonite, the mythical element that weakens Superman, goes back to 1943, a few years after Superman himself came on the scene. Fast forward to October 2014 and a company called Ravensmoon Productions, which had already been selling its Kryptonite Vapor product and using kryptonite in its domain name for months, has filed to register the KRYPTONITE VAPOR mark in the category of electronic cigarette refill cartridges. DC Comics has objected, and it looks like Ravensmoon is about to back down.
