The government has been scrutinizing “facially neutral” policies and agreements, including confidentiality agreements, on the grounds they may be squelching whistleblowing. Both the SEC and OSHA are involved. The plaintiff attorneys are circling. Is there anything companies can do to reduce the likelihood of a whistleblower action?
