SCOTUS Could Weigh In On White Collar Overtime

With lower federal courts coming to different conclusions about whether certain white collar workers are eligible for overtime pay, the matter may ultimately be decided by the Supreme Court. Last week the U.S. District Court in the Eastern District of California found that Provident Savings Bank FSB could classify the underwriters as being exempt from overtime rules under the Fair Labor Standards Act; that case is likely to be appealed to the Ninth Circuit. Conversely, in a similar 2011 case the Second Circuit Court of Appeals found that JPMorgan Chase & Co. could not make its underwriters exempt, prompting many banks to pay millions to settle similar complaints.
