Antitrust Whistleblower Law Passes The Senate

The Senate has passed the Criminal Antitrust Anti-Retaliation Act of 2015  (CAARA). It gives protection to whistleblowers who provide, to either their employer or to the government, information they believe relates to antitrust violations. Those protected include, in addition to employees, contractors, subcontractors and agents of the employer. There is no bounty in this program, although there is the possibility of reinstatement, back pay with interest, costs and attorneys’ fees. “It will be interesting to see to what extent CAARA encourages potential antitrust tipsters to come forward,” write attorneys from Drinker Biddle & Reath.
