Under the new NLRB rules for union elections, employers have less time between the petition being filed and the election. Two Hunton & Williams LLP lawyers share what they learned from running a successful campaign to prevent unionizing. “Our experience under the new rules taught us that, though elections are still winnable, there is no room for error,” Gregory B. Robertson and Ryan A. Glasgow write, “and there is not enough time to begin a campaign from scratch once the petition is filed.” They outline navigating new procedural requirements, while preserving challenges to the rules. “A union organizing campaign under the new rules is a crisis,” they write.
