Much-Used Chemical Coming Soon To Prop 65

A client alert to makers and sellers in the California market, from Morrison & Foerster: Barring a successful court challenge by the American Chemical Council, on December 20 a widely-used chemical known as diisononyl phthalate (DINP) will be added to the list that requires a proposition 65 warning. Products that contain DINP range from vinyl flooring, cable insulation and garden hoses to footwear and toys, as well as many paints and adhesives. “Bounty hunter” plaintiff attorneys are eagerly awaiting the new listing, write attorneys Michael Steel and Lois Miyashiro. They also note a number of other chemicals that will be added to the list in early 2015.
