Lovelace “Biopic” Doesn’t Infringe Deep Throat

The U.S. District Court for the Southern District of New York has ruled that recreations of scenes from the landmark 1972 pornographic film “Deep Throat” were transformative, and therefore were protected under the fair use doctrine, writes Blake Brittain, in Bloomberg BNA. The scenes in question were part of a Weinstein Co. biographical film about Linda Lovelace, the stage name of the late Linda S. Boreman.  Arrow Productions Ltd., the producers of the original film, sued the Weinstein Co. in 2013, alleging infringement.
