Wellness Program Holdout Fired, EEOC Sues

The EEOC has filed the first lawsuit to challenge a company wellness program under the Americans With Disabilities Act. After an employee of a Wisconsin manufacturing company declined to participate in a wellness program, she was required to pay a $50 penalty on top of her health insurance premium and later fired, according to the EEOC complaint. The case, Equal Employment Opportunity Commission v. Orion Energy Systems, was filed in district court in the Eastern District of Wisconsin, in Green Bay.
