At-Will Doctrine Alive And Well In Texas

Attorney David Barron of the Cozen O’Connor firm reviews a case in which Du Pont induced employees to join a spin-off with a promise that the new company wouldn’t be sold, and their pay and benefits would not be reduced. Shortly after the employees decided to stay with the spin-off it was sold, and their wages and benefits were reduced. The Texas Supreme Court decided that the employees couldn’t sue. It did note a limited exception to the “at will” doctrine.
