Environmental Marketing Scrutinized By FTC

Two recent settlements between the FTC and companies accused of making misleading claims about their products should serve as a warning, write attorneys from Arent Fox. The claims in question related to purported biodegradability and use of recycled content. The takeaway: Failure to adhere to guidelines and definitions in the FTC document titled Guides for the Use of Environmental Marketing Claims could bring FDA scrutiny, and some of the definitions don’t leave much room for argument.
