Capital One Contract Says It Can Visit Customers At Home

In an updated contract sent to customers recently, credit card issuer Capital One said it reserves the right to contact card users “in any manner we choose,” including personal visits that may be “at your home and at your place of employment.” Some legal analysts have said they don’t believe the contract violates customers’ Fourth Amendment rights – the right against unreasonable searches and seizures – because Capital One is a commercial venture rather than a branch of law enforcement. Capital One also says it reserves the right to identify itself as another entity on caller ID systems, a tactic that is legal if it’s not part of a fraud or “harmful,” and which is frequently employed by telemarketers.
