Judge In Murder Case OKs DNA Snatched By Cop Posing As Busboy

A judge has ruled that DNA evidence taken from a suspected serial killer by an undercover cop disguised as a busboy would be allowed at trial, rejecting the argument that the man had reasonable expectation his plate and utensils would be thrown in with the the others. Los Angeles County Superior Court Judge Kathleen Kennedy called the argument “specious and ridiculous,” clearing the way for any DNA obtained at the restaurant to be used as evidence in the trial of Lonnie Franklin Jr., who is a suspect in the murder of 10 women.
