The statutory definition is neat and straightforward: Under the Equality Act 2010, conduct is harassment if it’s unwanted and has either the purpose or the effect of violating dignity or creating an offensive, intimidating or hostile environment. But there are many shades of gray, and two recent cases raise the question of how much “context” will or should weigh in a determination.
