Appeals Court: Patent Office Rulings Are Binding On Concurrent Litigation

In a decision that could have significant impact, the United States Court of Appeals for the Federal Circuit recently determined that if the U.S. Patent and Trademark Office in post-grant proceedings declares a patent invalid, that determination is binding on any concurrent infringement litigation.
