Social Media ‘Evidentiary Goldmine’

Reviewing social media is now a matter of basic due diligence, two social media lawyers explain in a Q&A, saying that data has become “an evidentiary gold mine.” With eighty percent of Americans regularly using social media, attorneys may actually risk facing a malpractice claim for failing to examine the publicly available data. Companies would also do well to review their IT policies, which may have been written years ago, to be sure all document retention policies and litigation hold procedures take social media into account.
