Class Action Lawsuits Have Not Disappeared

After two high-profile Supreme Court decisions, AT&T Mobility LLC v. Concepcion in 2011 and American Express Co. v. Italian Colors Restaurants, decided in June, many observers expected class action lawsuits to become a thing of the past. Some kinds of class actions have become more difficult to mount, but beyond that, according to the writer, “it’s not clear that these cases have done much more than shift some of the terms of early motions practice.”
