Pending Supreme Court Case Will Impact Union Campaigns

In a case that has received little attention, the issue is whether a so-called neutrality agreement between an employer and a union attempting to organize a workplace violated Section 302 of the Labor Management Relations Act, by providing a “thing of value” to the union. The case was brought by an anti-union employee working with the National Right to Work Legal Foundation. The outcome, according to the writer, could have a significant impact on the ability of a union to mount an effective organizing campaign.
