Supreme Court Generic Drug Decision Could Benefit Ag Chemical Defense

The Supreme Court’s recent decision in Mutual Pharmaceutical Co. Inc. v. Bartlett, which held that the Federal Food, Drug and Cosmetic Act preempts state law design defect claims against manufacturers of generic drugs, could bolster the defense in product liability cases involving FIFRA-regulated products, such as herbicides and pesticides.
