What began as a wave of privacy class actions has settled into something more persistent. For several years now, a small number of serial plaintiffs have been sending thousands of templated demand letters under the California Invasion of Privacy Act (CIPA), targeting businesses of every size over routine analytics and marketing tools.

The landscape is shifting, but not the way many expect. California’s newly signed SB 690 will end private “pen register” claims over website tracking starting in January, and a federal court recently declared prolific demand-letter sender Vivek Shah a vexatious litigant. Both are interesting developments, but neither eliminates risk going forward. Plaintiffs are adapting with new theories, new venues, and a growing push toward arbitration. The exposure isn’t going away.
